Alpha Servers (ASI)

Alpha Servers (ASI) strives to provide our clients with the best value for all your gaming needs. This means low latency servers running on stable Linux platforms. We guarantee that our servers are up and running 99% of the time. As a client, there are certain guidelines and restrictions that must be followed. Your use of our services acknowledges that you have read and understood this agreement and are bound to the terms and policies. If, at any time, you do not wish to be bound by this agreement, you should contact Alpha Servers immediately so your account can be closed.

Failure to comply with these terms will result in the termination of your account with no refund. Customers are subject to the most current version of the TOS at the time of such use, which is this document. While Alpha Servers does not monitor individual game servers (only the hardware and network from which they are hosted), we reserve the right to inspect any game server to insure they are not abiding by our Terms of Service. Alpha Servers reserves the right to remove and terminate the server and account of any customer, for any reason. Upon notice published on its Web site, Alpha Servers may modify these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change services offered.

Service Usage

Alpha Servers' services may only be used according to the law. Any use of these services that violates any local, state, federal, or international laws, which may apply to Alpha Servers, your local jurisdiction, or any jurisdiction that you or your site may be subject to is strictly prohibited.

Server Upkeep - You are responsible for the upkeep of your server. This includes, but is not limited to, adding maps, game play related files and server configuration modifications. If your server is down you are required to notify us as soon as possible. We do not monitor game servers on an individual basis, however, our server management system will restart servers if they crash and gives you control to remotely restart your game server in the event, it freezes or you make configuration changes that require a restart. We want to help limit the amount of downtime you may experience due to server crashes, et cetera. You must insure that your server abides by our term of service at all times.
Server Usage - Game servers come with a base setup, and any additional files, maps, or configs are to be applied by the customer. Alpha Servers will assist in maintaining server files if requested. You are responsible for your files and the contents of your server, including backup of files beyond the base setup. Game servers may be maintained via FTP. You may not use the game server to run a file site or for file storage. We strictly forbid storing of porn, warez, or other unnecessary/illegal files on the game server.
Player/User Limits - Game and voice server rates and size limits cannot be changed without notification and payment to Alpha Servers. Violations can result in immediate termination of service without refund. If your server is found with more players set then for the service you signed with your server will be charged for those additional players.
Private Servers - If you are renting a private game server, then that game server is to remain password protected and locked at all times. You may not share or loan your server to any other clans, unless it's a clan you are having a match against. Your server password may not be advertised to the general public. Server passwords may not be posted in the server name. Our private servers are designed for clan use only and is not intending to be used as a public game server. Servers found without a password set will be charged as a public game hosting customer for the current billing month. Public servers, however, can have no password set and may freely changed from password protected to public at your command.
Security - Alpha Servers employs reasonable and current security methods to prevent unauthorized access, maintain data accuracy, and ensure correct use of information. Your account information and profile are password-protected. Do not divulge your password to anyone. Alpha Servers will never ask you for your password in an unsolicited phone call or in an unsolicited e-mail.

Pricing and Payment

You agree to supply appropriate payment for the services received from Alpha Servers, in advance of the time period during which such services are provided. You agree that until and unless you notify Alpha Servers of your desire to cancel any or all services received, those services will be billed on a recurring basis. You may change, upgrade or downgrade your service at anytime. Additional fees may apply for service upgrades if you are upgrading service in the middle of your current billing cycle. There are no prorated service credits for service downgrades. There are no refunds on unused service. All payment collection is done by Alpha Servers when paying via credit card the name on your statement will appear as Alpha Servers. If you have questions about your billing please contact our billing department.

All pricing is subject to change. Pricing is locked at the time of initial sign-up and is not subject to change unless the account holder falls behind in monthly payments. Ten (10) days prior notice is required to cancel an account. Any uncollected balances must be paid when you cancel.

You agree that you as the person legally responsible for use of this account, are at least 18 years of age or have parental/guardian permission. You agree to supply Alpha Servers with a current and truthful name and email address, and you have a continued obligation to keep this information current. You also agree that you are an authorized user of any credit card that you supply to us and agree that we have an obligation to fully investigate any possible fraudulent credit card use.

You agree to provide accurate information when you register. Any falsification of registration information with the intent to deceive Alpha Servers will render all obligations Alpha Servers has towards you null and void. Any change of contact information must be edited by the account holder in their profile in the members section of the Alpha Servers Web site.

Service Level Agreements and Refund Policies

Refunds - You are eligible for a refund if we do not maintain 99% hardware or network uptime based on a 30 day period over the system your service is hosted on or we are unable to correct or fix service related issues that are a result of no fault of your own within 14 days you are then eligible for a prorated refund. While your ping times will be more then enjoyable on our service we will not issue refunds that are due to ping issues with you or your server members. Since there are so many ways to travel on the Internet it would be impossible for anyone to guarantee Internet ping times. We do our best to host your game server on the best bandwidth quality as possible. All refunds are based on a prorated remainder of your service time and may only be requested by contacting our billing department.
Service Credits - We will credit your account if your server is down for a period of time of more then 8 hours in any given day due to hardware or network issues. Credits will be determined by our staff at the time of the issue and will be credited directly to your online account once the issue is resolved. Service credits may not be paid in cash, or refunded to credit cards.
3 Day Change Your Mind Policy - If for whatever reason you do not wish to keep service with us you can request a refund for service if within your first 72 hours of service. Since we do not charge a setup fee for our service there will be a charge of $29.00 deducted from your refund to cover our setup and staff costs.

Indemnification

In no event will Alpha Servers be liable to customer for any consequential, direct or indirect, special, incidental damages or any loss of profit, revenue, data, or goodwill whether incurred or suffered as a result of unavailability of the services, performance, nonperformance, negligence, termination, breach, or action or inaction under this agreement even if client advises Alpha Servers of the possibility of such loss or damage. This indemnification and hold harmless agreement extends to all issues associated with your account. The foregoing limitation on liability, however, shall not relieve Alpha Servers from liability for direct damages arising solely out of Alpha Servers gross negligence or wanton or willful misconduct in performance of the hosting services.
